Estado condenado a indemnizar emigrante por morosidade judicial

Bairos Fernandes ainda não recebeu indemnização do ex-presidente
do Conselho de Administração da Caixa Económica Faialense


O Tribunal Administrativo e Fiscal de Lisboa condenou o Estado a pagar uma indemnização de 60 mil euros por danos morais causados a José Bairos Fernandes, um emigrante português no Canadá, que esperou 18 anos por uma sentença definitiva dos tribunais portugueses, por ter sido lesado em 115 mil contos devido à falência da Caixa Económica Faialense (CEF).

A decisão não quantificou o montante de indemnização que o emigrante deverá receber por danos não patrimoniais, verba que deverá ser fixada quando aquela decisão for executada.

José Bairos Fernandes, recorde-se, está a receber, desde Agosto de 2003, uma renda mensal de 1200 euros que lhe foi atribuída pelo Tribunal Central Administrativo (TCA), quando este tribunal de segunda instância deferiu uma providência cautelar apresentada no quadro da acção em que o emigrante reclamava 550 mil euros pelos danos causados pela morosidade superior a 18 anos para haver uma decisão final do processo da Caixa Económica Faialense (CEF).

Bairos Fernandes ficou na miséria e esperou 18 anos para ver o dirigente máximo da CEF condenado e preso, mas ainda não conseguiu reaver as economias que tinha confiado àquela instituição.

“Um mar de destroços”

O processo da Caixa Económica Faialense é, aliás, um dos mais exemplares casos de morosidade da justiça portuguesa, que não foi capaz de adoptar uma decisão definitiva em 18 anos.

Bairos Fernandes viu-se privado “do produto de uma vida inteira de trabalho como emigrante no Canadá”, como reconheceu um acórdão do Supremo Tribunal de Justiça, proferido em 15 de Outubro de 2003.

Nesta decisão, recorde-se, o STJ condenou Américo Duque Neto, ex-presidente do conselho de administração da CEF, a cinco anos de prisão e ao pagamento de uma indemnização de 2,5 milhões de euros àquele emigrante, que também ainda não foi liquidada.

Duque Neto foi ainda condenado em 1500 euros de imposto de Justiça.

Os conselheiros indeferiram alegadas inconstitucionalidades invocadas pelo réu, salientando que agiu com “dolo directo” e manifestou uma “profunda indiferença pela condição económica do assistente [Bairos Fernandes], que lançou para a total penúria”.

“Em curto espaço de tempo”, acrescenta o acórdão do STJ, aquele emigrante ficou na impossibilidade de “prestar auxílio a seus dois filhos que dele careciam, um deles afectado de paralisia cerebral grave, reduzindo-o, passe a palavra, a um mar de destroços”.

18 anos à espera de uma sentença! desgaçado homem. como dizem os distintos magistrados, a culpa deve ser outra vez dos políticos... e não há DIREITO DE REGRESSO do Estado sobre os responsáveis: 60.000 € que poderiam ser recolhidos filantropicamente pelos sindicatos nos dias de greve...
